Gillmor Gang 12.24.11 (TCTV)

Gillmore Gang test patternThe Gillmor Gang ? Robert Scoble, John Taschek, Kevin Marks, and Steve Gillmor ? took a WiFi stroll through the forest that is Hollywood's attempt to lock down our TVs. It's really too late, what with SOPA boycotts, reverse engineering of the Apple AirPlay bus, and Microsoft's slow fade from CES underway. But that doesn't stop the Cartel from trying. It may turn out that you can someday move network news shows from Slingbox to the iPad and back up to Apple TV over WiFi, but for now the realtime bus is getting choked. In fact all things streaming is about to collide with bandwidth caps, at least in our house. With 5 Apple TVs and counting, it won't be long before WiFi consulting becomes a trade school offering. Me, I'm off to Fry's. Happy Holidays.

Act as if You're Being Filmed at Work [Video]

Act as if You're Being Filmed at Work Most of us have seen the YouTube video of a FedEx driver throwing a computer monitor over a fence. This driver will probably be facing pretty stiff disciplinary action. If he had acted as though he knew he was being recorded he might have done his best to gently place the package over the fence. The resulting video would not have gone viral and the driver might now be up for a raise instead of a reprimand.

Personal Finance weblog The Simple Dollar points out that most of us are fortunate enough not to have our worst days at work broadcast over the internet, but the best way to establish a career reputation is to always behave at work as though you're being recorded. This will keep you from taking shortcuts and doing things like throwing away a stack of paperwork rather than dealing with it. Video by goobie55

Chris Tina Bruce: 'LGBT' Transforming into Alphabet Soup?

LGBTQIAAP: lesbian, gay, bisexual, transgender, queer, intersex, asexual, allies, and panseuxal

Really? Are we trying to communicate a message or create alphabet soup?

As a newbie to the LGBT community, I felt it was my responsibility to learn the history and understand how we came to be where we are and how I can help move us forward. These are the majority of acronyms and definitions (based on GLAAD's glossary of terms), even with some disagreement within our community:

  • Lesbian: a woman whose enduring physical, romantic, and/or emotional attraction is to other women. Some lesbians may prefer to identify as gay, or as gay women.
  • Gay: the adjective used to describe people whose enduring physical, romantic, and/or emotional attractions are to people of the same sex (e.g., a gay man, gay people).
  • Bisexual: an individual who is physically, romantically, and/or emotionally attracted to men and women.
  • Transgender: an umbrella adjective for people whose gender identity and/or gender expression differs from the sex they were assigned at birth. The term may include, but is not limited to, transsexuals, cross-dressers, and other gender-variant people. Transgender people may identify as female-to-male (FTM) or male-to-female (MTF). Transgender people may or may not decide to alter their bodies hormonally and/or surgically.
  • Queer: traditionally a pejorative term, "queer" has been appropriated by some LGBT people to describe themselves. However, it is not universally accepted even within the LGBT community and should be avoided unless quoting or describing someone who self-identifies that way.
  • Questioning: the adjective used to describe people who are unsure of their sexual orientation.
  • Intersex: the adjective used to describe a person whose biological sex is ambiguous. There are many genetic, hormonal, or anatomical variations that make a person's sex ambiguous (e.g., Klinefelter syndrome). The term "intersex" is not interchangeable with or a synonym for "transgender."
  • Asexual: an individual who is not physically, romantically, or emotionally attracted to others.
  • Ally: a person who is not lesbian, gay, bisexual, transgender, queer, questioning, intersex, asexual, or pansexual but who supports the LGBT(QQIAAP) community.
  • Pansexual: a person who is attracted to others without taking gender or biological sex into account.

Even in our own community, we are not clear on all the acronyms that represent us. If I, as a person in the LGBT community, am having a hard time understanding and knowing all the acronyms sprouting up every other month, how can we honestly expect mainstream America to understand?

Our message is supposed to about unity to obtain equality, although we cannot even communicate a clear and consistent message. I believe that we are doing ourselves a disservice by expanding our acronym for every micro group instead of projecting a simple and understandable message of equality for all.

A large percentage of mainstream America currently does not even understand the differences between sex, gender, and sexual orientation, and the expansion of additional acronyms only helps to dilute our unity and message. I experienced this lack of knowledge firsthand in my coming out. Just two years ago, while opening up to my mom after 40 years of living as her all-American, football-star and bodybuilding son, she was quite shocked, although she took it in her motherly, loving way. A few weeks (and many hours of talking about the whens, wheres, hows, etc. of being transgender) later, she made a comment that I will never forget: "So you consider yourself more female than male, but you do not like men and still date women? I do not understand." My 60-something, educated, open-minded, and loving mother, like many others, really did not understand the difference between sex, gender, and sexual orientation.

A common misconception is that gender and sex are the same. Wrong. Sex is based on the reproductive organ supplied at birth, whereas gender is the mental perception you have of yourself, and then there is sexual orientation, or your sexual preference (e.g., heterosexual, homosexual, bisexual, etc.). In other words, your sex is between your legs, your gender is between your ears, and your sexual orientation is between your sheets. I produced this video to help explain the differences between sex, gender, and sexual orientation for my family and friends.

For the large majority of our population, gender and sex are congruent, and they are heterosexual. For example, Johnny is born with male sex organs, his gender (the way he perceives himself) is male, and his sexual orientation is heterosexual. I, being giftedly gendered, was born with male sex organs, but my gender is more female than male, and my sexual preference has always been toward women. So then am I a trans lesbian? Do we now add another letter to our ever-expanding alphabet soup? I say no. I prefer to the win the war of equality and will sacrifice a few small battles, as the movement is about us, not about me. So let's keep the LGBT a clear, united, and simple message of equality for all.

Be Bold, Be Proud, Be Yourself.

(AP) ? The attorney for a man with extensive ties to white supremacists asked a judge Tuesday to withdraw his client's guilty plea in connection with a plan to detonate a bomb at a Martin Luther King Jr. Day parade.

The request by Kevin Harpham's defense team came just hours before he was scheduled to be sentenced in Washington state. Harpham previously agreed to a plea deal charging him with attempted use of a weapon of mass destruction, and the hate crime of placing the bomb in an effort to target minorities.

He faces 27 to 32 years in prison.

Harpham told a judge in September that he placed a pipe bomb loaded with poison-laced metal along the parade route in Spokane as an attempt to commit a hate crime.

The Jan. 17 parade drew about 2,000 and was forced onto an alternate route after the bomb was found.

Harpham is an Army veteran who has extensive ties to white supremacist groups but no record of past crimes.

The Southern Poverty Law Center, which tracks hate groups, has said Harpham made more than 1,000 postings on a white supremacist website. The center also has said Harpham belonged to a neo-Nazi group.

Denver forms committee to explore 2022 Olympics

(AP) ? The city of Denver is forming a committee that will look into bidding for the 2022 Winter Olympics.

The committee will present findings to mayor Michael Hancock and Gov. John Hickenlooper, who said Friday the idea of a bid is worth taking seriously.

The International Olympic Committee awarded the 1976 Winter Games to Denver, but the city later turned them down. IOC president Jacques Rogge said this year that the history would not have a bearing on a future Denver bid.

The Reno-Tahoe area is also considering making a run at the 2022 Games, though the U.S. Olympic Committee is not committed to backing an American bid.

SOPA hearings underway, tech policy wonks can stream it live

IPRLike any good tech geek you're probably at least interested in, if not a little concerned by SOPA -- the Stop Online Piracy Act. Well, today is its day in front of the House Judiciary committee. While this is hardly the last stop on the road towards becoming a law for the bill it is one that will be crucial in deciding its fate. Will it be toothless and unenforceable? Simply die in committee? Or will this become a powerful new tool in the battle against piracy? If you're the really wonky type hit up the source link to watch a live stream of the debate.

[Thanks, Tyler]

Global markets cautious over economic gloom (AP)

LONDON ? Signs of a global economic slowdown and stresses in Europe's financial system kept investors cautious on Thursday, causing losses in Asian markets, limiting gains in Europe and keeping the euro near 11-month lows.

Surveys showed Japanese business confidence and Chinese manufacturing had both slipped, while European industrial and services sectors continued to contract, though less than expected.

Concerns over Europe's debt crisis are squeezing credit conditions for banks in the region. The fear that a bank might not be able to withstand losses on its holding of shaky government bonds makes the banks less inclined to lend to each other, as they normally do to fund their hugely expensive daily operations.

Many banks are relying on cheap credit from the European Central Bank for that money, but in the meantime they are cutting down on lending to businesses and households.

As a result, the real economy in Europe is sliding toward recession.

The purchasing managers' index published by financial data company Markit showed eurozone manufacturing and services output contracting for a fourth month in December, although not as much as economists were expecting. The combined index for the two sectors stood at 47.9 in December, up from 47.0 in November. A figure below 50 indicates contraction.

"The likelihood remains that eurozone GDP will contract in the fourth quarter, even if the decline may not be as has been feared," said Howard Archer of IHS Global Insight in a report.

A day after suffering sharp losses, European stocks rose slightly. Britain's FTSE 100 rose 0.5 percent to 5,395.37. Germany's DAX gained 0.9 percent to 5,727.67 and France's CAC-40 added 0.6 percent to 2,993.30.

Wall Street was likewise headed for modest gains, with Dow Jones industrial futures up 0.2 percent to 11,784 and S&P 500 futures gaining 0.5 percent to 1,211.80.

The euro was steady at 1.2993, near its lowest levels so far this year.

Since European leaders reached an agreement to rein in future government budget deficits last week, investors and credit rating agencies have criticized the deal for failing to address current problems.

Italy had to pay higher interest rates in its last bond auction of the year on Wednesday. The longer the country's borrowing rates remain high, the bigger the financial burden will be. The higher rates reflect rising doubts that the country will be able to repay its debts.

The Italian government will hold a confidence vote on its euro30 billion ($39 billion) package of tax hikes and spending cuts that have been hotly contested by lawmakers and unions.

Stocks faced stronger headwinds earlier in Asia. Japan's Nikkei 225 index shed 1.7 percent to close at 8,377.37, a three-week low. South Korea's Kospi lost 2.1 percent to 1,819.11 and Hong Kong's Hang Seng tumbled 1.8 percent to 18,026.84.

Mainland Chinese shares lost ground for a sixth straight trading day, with the benchmark Shanghai Composite Index falling 2.1 percent to 2,180.90, while the Shenzhen Composite Index lost 2.3 percent to 886.01.

In Japan, confidence at major manufacturers fell over the last quarter. The Bank of Japan's "tankan" survey of business sentiment fell to minus 4.

The figure represents the percentage of companies saying business conditions are good minus those saying conditions are unfavorable, with 100 representing the best mood and minus 100 the worst.

Japan's strong yen has hit multiple historic highs this year against the dollar, making business conditions difficult for Japan's export-reliant economy.

Meanwhile, preliminary manufacturing figures showed that Chinese factory output contracted, but at a slower rate, in December. HSBC's purchasing manager's index for December stood at 49.0, up from 47.7 in November. Any number below 50 indicates a contraction in manufacturing activity.

But the figure didn't raise hopes that China might ease its monetary policy anytime soon.

"I don't think there will be an interest rate cut in the short-term," said Dickie Wong, executive director of research at Kingston Securities Ltd. in Hong Kong. "Sentiment is really bad in China."

The dollar slipped to 77.91 yen from 78.07 yen late Wednesday in New York.

Oil prices, which plunged more than $5 on Wednesday, drove down energy-related shares and steadied on Thursday.

Benchmark oil for January delivery was up 81 cents at $95.72 a barrel in electronic trading on the New York Mercantile Exchange. The contract declined $5.19 to finish at $94.95 per barrel on the Nymex.

Why gun sales spiked on Black Friday

Jeff Roberson / AP

Imagine finding one of these under the Christmas tree? A record number of background checks for gun purchases were performed over the Black Friday weekend, the FBI says.

By Martha C. White

Americans spent some $52 billion on Black Friday weekend. In addition to sweaters and iPods, though, shoppers were scooping up something else in large numbers: guns.

According to the FBI, which processes requests for background checks of prospective gun buyers, 129,166 such checks were performed on Black Friday, Nov. 25, breaking the previous single-day record -- set on Black Friday 2008 -- by nearly a third. The surge in gun sales?was initially reported by USA Today.

Analysts who focus on firearms say this increase is part of a years-long trend toward increasing gun ownership.?In a recent Gallup poll, 47 percent of respondents said there was a gun in the household, up from 41 percent just one year ago.?

More people are buying guns these days, particularly handguns, said Cai von Rumohr, managing director at investment company Cowen & Co. For all of November, the number of background checks processed by the FBI rose by around 16 percent vs. year-ago levels.

"These numbers have been relatively strong, and I think more of it has been the trend towards lower-priced, smaller weapons," von Rumohr said.?For the most part, it's unlikely these weapons are being bought to wrap up and put under a Christmas tree; many states have laws that prohibit buying a gun for someone else. ?

The?number of first-time buyers and women?buying guns has been on the rise for a few years, which may have contributed to the high numbers on Black Friday. Data from the National Sporting Goods Association show an increase in the number of female gun consumers, including a nine percentage point jump from last year to this year. Also, every state?except for Illinois now lets residents carry concealed weapons.

"Retailers tell us 25 percent of customers are first-time buyers," said Larry Keane, vice president and general counsel at the National Shooting Sports Foundation, a firearms industry trade association.?Many gun dealers that enroll firearm novices in safety and training courses report that their classes are full or wait-listed, another indication of?growth in the number of?new gun owners, he said.?

Caroline Brewer, director of communications at the Brady Campaign to Prevent Gun Violence, called the Black Friday surge a "one-time event." She said any increase in gun purchases "may be the result of marketing."

If marketing is the cause, it appears to be successful.

"Whereas five years ago it was politically incorrect (to own guns), ...?what seems to be changing is social acceptance," said Bret Jordan, analyst at investment firm Avondale Partners. "I think there might be a changing view of firearms."?

Jordan said the industry saw a?surge in gun purchases around the time of the last presidential election, apparently because?hunters and other enthusiasts feared?President Barack Obama would push for more gun-control laws or stronger restrictions.

"When Obama was elected, I think people rushed out and stocked up on their tactical rifles," Jordan said, referring to military-style weapons that were potential targets of?legislative restrictions.

More recently, though, the focus has switched to handguns. In spite of the economic downturn, "The category of firearm that has continued to sell very well is something one would have if they were concerned about their personal safety," Jordan said.

"The general trend is it's more socially acceptable to own a gun in the United States than it was five to six years ago," he said.?

Would you buy someone a firearm for Christmas?

Ivory Coast's Gbagbo appears before int'l court (AP)

THE HAGUE, Netherlands ? Ivory Coast's ex-president appeared at the International Criminal Court on Monday, the first former head of state to face judges at the world's first permanent war crimes court. Laurent Gbagbo vowed to fight the charges against him.

Gbagbo, 66, was calm and smiled at supporters in the public gallery as the 25-minute hearing opened. He told judges he did not need them to read the charges.

Gbagbo was extradited to the Netherlands last week to face charges that his supporters committed murder and rape as he rejected an election result and tried to cling to power.

Prosecutors say about 3,000 people died in violence by both sides after Gbagbo refused to concede. President Alassane Ouattara took power in April with the help of French and U.N. forces.

The former president, speaking in French, said he wanted to see the evidence against him.

"I will challenge that evidence and then you hand down your judgment," he told the three-judge panel.

Gbagbo also complained about his arrest by opposition forces backed by French troops in April, saying he saw his son beaten and his interior minister killed in the fighting.

"I was the president of the republic and the residence of the president of the republic was shelled," he said.

He also complained about his transfer to The Hague last week from northern Ivory Coast where he was under house arrest.

"We were deceived," he said, adding the official in charge of his transfer "did not have the courage to tell me I was going to The Hague."

Monday's brief hearing was to confirm Gbagbo's identity and ensure that he understood his rights and the charges. According to court papers, Gbagbo is charged as an "indirect perpetrator" in a carefully orchestrated campaign of violence against supporters of Ouattara.

Presiding judge Silvia Fernandez de Gurmendi of Argentina scheduled a hearing for June 18 where prosecutors will present a summary of their evidence and judges will decide whether it is strong enough to merit bringing Gbagbo's case to trial.

Before that, judges will schedule interim status conferences to discuss progress in the case. Gbagbo could challenge his detention at such a conference and seek to be released pending further hearings.

Even before Gbagbo was led into the courtroom, his lawyers called his arrest and transfer to the court French "neocolonialism."

"It's a neocolonialist trial," Gbagbo's adviser Toussaint Alain told reporters in The Hague. "The (ICC) has become an instrument of France ... to empower friends and punish the ones who don't follow along."

Gbagbo's lawyer Habiba Toure also challenged the legitimacy of the Gbagbo's detention last week on an ICC warrant while he was under house arrest.

"In principal, an arrest warrant is delivered to a free individual or a person on the run, which was not the case for Mr. Gbagbo because he was already in the hands of Ivory Coast officials," Toure said.

A handful of supporters outside court also condemned France's role in his ouster.

"This is a masquerade by French President Nicolas Sarkozy," said Abel Naki, who traveled from Paris to be at the court. "Sarkozy orchestrated this coup d'etat."

The protesters' anger underscored lingering tensions between Gbagbo and Ouattara supporters in Ivory Coast.

The court's chief prosecutor, Luis Moreno-Ocampo, stressed last week that both sides of the political divide in Ivory Coast committed crimes in the postelection chaos and that his investigation was continuing.

Human rights groups say grave abuses also were committed by forces loyal to Ouattara, who enlisted the help of a former rebel group to force Gbagbo from office.

Gbagbo is the sixth suspect taken into custody by the court, which has launched seven investigations, all of them in Africa. A further 12 suspects remain at large and the court has no police force to arrest them.

Missing son of country singer Mindy McCready found in Arkansas (Reuters)

ST. PETERSBURG, Fla (Reuters) ? The missing five-year-old son of country singer Mindy McCready was found hiding in a closet with his mother in Arkansas, Deputy U.S. Marshall David Rahbany said on Saturday.

Zander and his mother were found in a vacant home in Heber Springs, Arkansas on Friday night, Rahbany said. The Florida Department of Children and Families had reported Zander missing from his grandfather's house in Cape Coral, Florida on Tuesday, and a Florida judge issued an order Thursday for Zander to picked up by authorities.

Mindy McCready's mother has legal custody of Zander but the singer has visitation rights and was with him when he was reported missing.

Rahbany, the chief deputy U.S. marshal for eastern Arkansas, said officials believed that McCready, 36, and Zander might be at the home of her boyfriend David Wilson in Heber Springs. A neighbor reported there were lights on at a nearby vacant house and marshals and members of the Cleburne County Sheriff's Department entered that home and found Wilson, McCready and Zander.

"She didn't resist," Rahbany said of McCready.

He said Zander was in the custody of the Arkansas Division of Child and Family Services. No charges were filed against McCready or Wilson.

"We're working with Arkansas officials to bring him (Zander) back as soon as possible," Terri Durdaller of the Florida Department of Children and Families said on Saturday.

Whoopsie - The NCAA Conference Championships

Can no one plan past their nose?

The Big 4 Conferences love money.

Last year the Big4 Football Conferences had 2 Conference Championship games. Everyone coveted the revenue, so this year two new Big4 confernces added a game, and in the process took one from the Big12.

So how's that working out?

Let's see. Looks like Oregon, the 2nd highest rated Pac12 team will be going to the RoseBowl. Is that right??? IF UCLA would have won, would they go to the Rose? Or would Stanford be the representatiive? or Oregon?

And Alabama, which will be T3 in the SEC is going to the BCS game, right?

And Oklahoma State is playing in a meaningless Bedlam, even though they are #3 right?

Conference Championship made INDEPENDENTLY of the BCS bowls make no sense whatsoever.

Or didn't anyone see that?

HOUSTON (AP) ? Mitt Romney is set to chat behind closed doors with former President George W. Bush. But Romney's campaign says no endorsement is eminent.

The Republican presidential hopeful was heading Thursday to Bush's home in Houston, even though he was venturing onto the home turf of a rival, Texas Gov. Rick Perry.

Romney spokeswoman Gail Gitcho confirmed the meeting saying, "they are friends," but added it doesn't mean Bush will endorse Romney.

The Bush's father, George H.W. Bush, endorsed Perry during the tight 1998 race for Texas lieutenant governor. Perry won.

Perry then became governor when the younger Bush left for the White House in 2000.

Both Perry and the younger Bush have denied reports of a rift between their camps dating back to their days working together in Texas.
